If the applicable product standard says you can. The '80-80 rule' is
actually standardized in CISPR 16-4-3/EN 55016-4-3 and 55022 just copies
it (more or less).
However, if you really have a series-production product and the
applicable product standard doesn't mention the 80-80 rule, I think the
current EMC Directive does not prohibit you applying it anyway; in the
event of a query you would have to justify applying it.
