I work in an environment where it is reasonable for me to assume that anything 
I write may be accessed by a plaintiff during the discovery process of some 
future lawsuit. It makes me more careful what I say, but it generally doesn’t 
prevent me from responding to a forum such as this. The disclaimer I use is 
based on guidance given by my current employer and is similar to what has been 
required at past employment when responding publically. I can say what I want 
as long as I indicate that it is a personal response and not necessarily the 
opinion of my employer. Despite the environment, my employer does not prohibit 
open communication on public forums. The employees are encouraged to speak 
responsibly and recognize that they may be seen as representatives of Microsoft.

I generally follow the advice of Mr. Nix and I have yet to have an issue with 
my employer. I can state that my management is aware of my participation in 
this forum. In regards to Mr. Perkins’ comments, I assume anything I send could 
be made widely available regardless of issues of digital security. Anybody on 
this mailing list could copy what I state and post it to another public forum. 
We don’t need spies or hackers to make this type of information more public. It 
can happen through far more innocent methods.

The knowledge that the information I post could become more widely available, 
and that it could be construed as representing my employer’s views makes me 
more cautious in what I post. However, that caution is generally limited to 
avoiding posting a response on a subject unless I have a reasonable level of 
confidence that I am providing useful and accurate information. Even then, I 
find I am occasionally providing either incomplete information or incorrect 
information. Fortunately, the experts on this list can balance out my ignorance 
when I show it.

How would you feel if you knew that some law firm considering a lawsuit against 
your company, was searching for everything you might have said over the past 20 
years, for evidence of utterances that might support their version of some item 
of contention? Or perhaps somebody was filing a complaint against your company, 
for reasons completely unrelated to you, but they searched for evidence of a 
“hostile corporate work environment” and found you making a joke about their 
purported sadness in 2007?

I could see that one bad experience like that might make corporate legal 
departments put a chill on all participation in openly searchable forums like 
EMC-PSTC.

I think what I’m saying is that I like the idea of my peers being able to 
search our archives, but beyond that, I see only liabilities.

I have watched this conversation for a few days and now I am beginning to 
wonder what is all the angst about.

I have been a member of the forum since about 1995 and the publically 
searchable archive is something I have used since the beginning. I find it very 
useful and have never assumed any level of privacy is expressed or implied. It 
is up to the individuals who make use of the forum to monitor their own 
privacy.  Spam is generally not a problem but has occurred on occasion. In 
those cases a gentle reminder followed by a reprimand from the admins has been 
enough.

In many ways this forum is patterned after the old BBSs or news groups (i.e. 
dejanews, yahoo groups) all of which were / are searchable.
