Hi Kevin, according to the information published by CENELEC, citation of EN IEC 63044-5-1 in the OJEU is not expected (CENELEC - CLC/TC 205 (cencenelec.eu)<https://standards.cencenelec.eu/dyn/www/f?p=CENELEC:110:0::::FSP_PROJECT:62338&cs=149B9A7F069F95C68BB11F7F9660F6677>). Nevertheless, you are free to reference EN IEC 63044 standards instead of EN 50491 standards in your Declaration of Conformity, as defined in EMC 2014/30/EU, Annex II, 3(d): "The technical documentation shall, wherever applicable, contain at least the following elements: [...] (d) a list of the harmonised standards applied in full or in part the references of which have been published in the Official Journal of the European Union and, where those harmonised standards have not been applied, descriptions of the solutions adopted to meet the essential requirements of this Directive, including a list of other relevant technical specifications applied." I recommend to include a short rationale in your risk analysis that the standards listed in the OJEU have been withdrawn at their respective DOW, and therefore no longer represent the state of the art to comply with the essential requirements of the EMCD, and to apply the superseding harmonised standards instead. Legally, you will no longer benefit from the presumption of conformity (Article 13 of the EMCD, https://eur-lex.europa.eu/legal-content/EN/TXT/HTML/?uri=CELEX:32014L0030&from=EN#d1e1161-79-1), but in a liability case, this may be a smaller problem than to reference standards that have been withdrawn almost 10 years ago by the standards organisation. Alternatively, if your equipment complies with both EN 50491 and EN IEC 63044, you may consider to reference both standards in your DoC, but I cannot estimate whether this will solve your problem with Turkish customs.

And I think the pain point was Turkey. I have that same pain point! A lot of my products fall under the HBES/BACS family. The current product standard is EN 63044-1 with the EMC subparts 5-1,2,3. The current versions are dated 2017-01. The summary list of harmonized standards for the EMCD (2014/30/EU) is dated 13-04-2022 and it only lists the EN 50491 series of standards. The DOW of the EN 50491 series was 03-03-2020. So the OJ is over two years out of date. Being bound by the OJ for my DoC's, I have been listing compliance to the EN 50491 standards. But, they are rejected by Turkey every time because they point out the long past DOW. And they demand a DoC stating compliance to the current EN 63044 series. So does anyone on this form know when the OJ will be updated, in particular, for my product standard series?
