INFORME FINAL DE LA REPORTERA ESPECIAL DE NACIONES UNIDAS

PEDIDO URGENTE
QUERIDAS/OS COLEGAS:
Este es un pedido especial de la Reportera Especial de Violencia contra la
Mujer, sus causas y consecuencias, en el contexto de la preparacion de su
Reporte Final a ser presentado en la Sesion 59 ante la Comision de DDHH.
Como Uds. Saben, la Reportera finalizara su mandato en el 2003. El Reporte
Final que debera presentar es el Informe final del seguimiento a su gestion
a manera de evaluacion sobre la eficacio o no de su rol. Este Reporte
debera indicar tambien como los Estados han implementado o no sus
recomendaciones, incluyendo las formuladas durante sus Misiones Especiales,
de manera que constituya una forma de evaluacion de su contribucion a la
eliminacion de la violencia que se ejerce contra la mujer desde el inicio
de su mandato, 1994. El periodo que abarca este informe final es de 1994-2003.
AREAS CONSIDERADAS DENTRO DEL REPORTE:
-Violencia contra la mujer en la familia.(ej. Violencia domestica,
practices tradicionales)
-Violencia contra la mujer en la comunidad (ej. Violaciones, acoso sexual,
trafico)
-Violencia contra la mujer perperada y/o condonada por el Estado (ej.
Violencia contra la mujer detenida, violencia perpetrada en condiciones de
arresto o custodia, violencia contra la mujer en situaciones de conflicto
armado)
Les pedimos su colaboracion en la preparacion de un analisis (max. 5
paginas) evaluando como las recomendaciones de la Reportera Especial se han
implementado y se incluya informacion relevante concerniente a:
-Estado de ratificacion de la Convencion sobre Eliminacion de toda forma de
discriminacion contra la mujer, su Protocolo Opcional y otros instrumentos
internacionales relevantes.
-Si los Estados cuando han remitido sus informes a CEDAW o a tras
comisiones han hecho referencia al trabajo/ recomendaciones de la Reportera.
-Cualquier iniciativa regional o nacional para fortalecer el marco legal y
el disenho de politicas para prevenir, eliminar, denunciar y combatir la
violencia contra la mujer.
-Cualquier politica ejecutiva o planes de accion que involucren el tema de
violencia contra la mujer.
-cualquier reforma constitucional relevante que se haya implementado asi
como si existe alguna autoridad a nivel constitucional que garantice
igualdad para las mujeres o que combata expresamente la violencia contra la
mujer.
-Cualquier informacion relevante que haya sido aprobada o que haya
conseguido alguna reforma de importancia de acuerdo a estandares
internacionales.
-Se ha usado el modelo propuesto por la Reportera para propuestas
legislativas en torno a violencia domestica?
-Existe alguna medida legal que proporcione apoyo adecuado a nivel legal o
administrativo para mujeres victimas de violencia?
-Existe cualquier directiva en referencia al desarrollo de mecanismos
legales o administrativos que aseguren justicia a las victimas de violencia?
-Cualquier dato estadistico sobre la incidencia de violencia de genero
-Es el sistema penal sensible a causas relacionadas con la comision de
actos de violencia contra la mujer? Hay entrenamiento especial sobre genero
dirigido a operadores del sistema penal para asegurar el buen manejo de
casos de violencia contra la mujer? Sobre esto, cual ha sido y es la
practica policial? Cuantos casos son investigados por la Policia? Cual es
el trato que reciben as victimas por parte de la Policia? Cuantos casos son
denunciados? Cual es el tipo de sentencias que se dan en estos casos?
Exisen profesonales de la salud que coordinen dentro del sistema a fin de
velar por el adecuado trato de las victimas ?
-Cualquier caso judicial relevante.
-Servicios de apoyo a las mujeres. Las mujeres tienen acceso a refugios,
consejeria y apoyo legal y psicologico, asistencia especializada y
rehabilitacion, proporcionados por el Estado o por ONGs?
-Se han tomado medidas adecuadas en el terreno educativo y de medios a fin
de mejorar los niveles de alerta y conocimiento por parte de la poblacion
acerca de la violacion de los derechos de las mujeres como una violacion de
DDHH? Incluir modificacion de practicas discriminatorias contra las mujeres.
-Dar ejemplos acerca de como el mecanismo/ rol de la Reportera Especial
como tal ha sido usado con exito a nivel regional y nacional para eliminar
distintas formas de violencia contra las mujeres.
-Cuando sea apropiado, incluir informacion y factores especificos a cada
pais y las dificultades encontradas para la implementacion de las
recomendaciones de la Reportera. Incluir areas principales de preocupacion
y recomendaciones para acciones futures tendientes a eliminar toda forma de
violencia contra la mujer.
Por favor, tener en cuenta la necesidad de incluir un analisis de tipo
global de la situacion actual referente a la eliminacion de violencia
contra la mujer. La Reportera Especial tambien incluira el seguimiento de
sus misiones desde 1994 (Republica Popular de Corea, Republica de Corea y
Japon; Polonia; Brasil, Sudafrica; Rwanda; EEUU; Indonesia y Timor del
Este; Cuba; Haiti; Afghanistan; Bangladesh;Nepal e India;Sierra Leona y
Colombia). Agradeceremos el envio de informes que mantengan actualizados
los hechos/ el analisis (max. 3 pags. Por pais) en relacion al estado de
implementacion de sus recomendaciones en los paises anteriormente citados.
Cualquier informacion, recomendacion o comentario que pueda enviarse
definitivamente sera una contribucion muy valiosa para la preparacion del
Informe de la Reportera ante la Comision de DDHH.La Reportera Especial

Dear colleagues,
Please find below a request for information from the Special Rapporteur on
violence against women, its causes and consequences (SRVAW) and myself, in
the context of the preparation of her final report to the 59th session of
the United Nations Commission on Human Rights.

I would like to inform you that Ms.Radhika Coomaraswamy will complete her
term of office as Special Rapporteur on violence against women in 2003. In
this context, the Special Rapporteur's report to the fifty-ninth session of
the Commission on Human Rights will be a follow-up report to evaluate how
effective the mechanism has been. The report will be divided into different
geopolitical regions, and will contain an analysis of how states have
implemented all of her previous recommendations, including those contained
in mission reports, to give an overview of the progress made in eliminating
violence against women since 1994.
The report will focus on a review of developments during the last 10 years
(1994-2003) in the following areas covered by the mandate:
- Violence against women in the family (eg domestic violence,
traditional practices.)
- Violence against women in the community (eg rape, sexual harassment,
trafficking)
- Violence against women perpetrated or condoned by the state (eg.
violence against women in detention and custodial violence, violence
against women in situations of armed conflict.)
Therefore we would like to request your kind assistance in preparing an
analysis (maximum 5 pages per country) of how recommendations, made by the
Special Rapporteur, to eliminate gender-based violence, in regards to the
three areas above, have been implemented by states and areas where there is
still need for action.
For example, it would be useful to include relevant country information on:
- The current status of ratification of the Convention on the Elimination
of All Forms of Violence against Women, its Optional Protocol and other
relevant international instruments.
Please mention whether States when reporting to CEDAW or other
committees have referred to the work/recommendations of the Special
Rapporteur
- Any regional or national initiatives to strengthen the legislative and
policy framework to prevent, eliminate and prosecute violence against
women
- Any executive policies or plans of action that attempt to deal with the
question of violence against women
- Any relevant constitutional amendments that have been enacted. Is there
constitutional authority guaranteeing equality for women or the
prohibition of violence against women?
- Any relevant legislation that has been passed/amended in accordance with
international standards
- Has the Special Rapporteurs framework for model domestic violence
legislation been used?
- Is there national legislation and/or administrative sanctions providing
adequate redress for women victims of violence?
- Any specific directives with regard to the development of legal and
administrative mechanisms to ensure effective justice for victims of
violence
- Is the criminal justice system sensitive to the issues of violence
against women? In this regard, what is police practice? How many cases
are investigated by the police? How are victims dealt with by the
police? How many cases are prosecuted? What type of judgements are given
in such cases? Are the health professionals who assist the prosecution
sensitive to issues of violence against women?
- Is there gender training for the criminal justice system to ensure the
appropriate handling of cases of violence against women?
- Any important court cases
- Any statistical data on the incidence of gender-based violence
- Any support services for women victims of violence. Do women who are
victims of violence have support services such as shelters, legal and
psychological counselling, specialized assistance and rehabilitation
provided either by the Government or by non-governmental organizations?
- Have appropriate measures been taken in the field of education and the
media to raise awareness of violence against women as a human rights
violation and to modify practices that discriminate against women?
Please give examples of how the Special Rapporteur on violence against
women mechanism has been successfully used at the regional/national
level in efforts to eliminate all forms of violence against women.
Where appropriate please include country specific factors and
difficulties facing implementation of the Special Rapporteurs
recommendations and principal areas of concern and recommendations for
future action to eliminate all forms of violence against women.
The Special Rapporteur will also follow up on all of her fact-finding missions
since 1994 (Democratic People's Republic of Korea, the Republic of Korea and
Japan; Poland; Brazil; South Africa; Rwanda; USA; Indonesia and East Timor;
Cuba; Haiti; Afghanistan; Bangladesh, Nepal and India; Sierra Leone and
Colombia.) We welcome any up to date information/analysis (maximum 3 pages
per country) in regards to the state of implementation of her specific
recommendations to the countries named above.
Any information, recommendations or comments you can provide will
contribute significantly to the preparation of the Special Rapporteur's
report to the Commission on Human Rights. The Special Rapporteur would
appreciate receiving information at your earliest possible convenience, and
at the latest by 1 August 2002, through the Office of the High Commissioner
for Human Rights, United Nations Office at Geneva. If possible please send

facilitate the processing of data for the report.
