They should in theory, though in practice, I hear that this doesn't
always happen. However, they know this happens, and if it does, 8pen's
patent can still be invalidated even after it's been granted. Really
though, this is completely up to Ken Perlin to defend. I wouldn't
worry about it.

If your concern if that you have licensed Ken Perlin's patent, you're
safe from any lawsuits from 8pen.
