I am also a (retired) lawyer. While a particular set of facts may not be black nor white, but shades of gray, it is very rarely true that the ends justify the means.
I don't know (nor do I care to know) the details of the situation, but I do NOT approve of distribution of software in violation of law or NDA. This is black and white to me, at least. Your opinions obviously differ. And to ask questions about beta software, knowing that legitimate users are bound by NDA seems foolish and a waste of bandwidth.
