Please state what version you are using. It helps us to give more meaningful answers. IF you are using vX this is a known problem - Empty Deleted Items doesn't always grab all the items on the first pass - it may take two or three passes. This will be fixed in a Service Release whenever it arrives. Meantime, just run the command a few times, or open the Deleted Items folder.
