Dave has it right...Percy has it right...how does the Boston FSDO know it was operated as a D model? The FAA issued Airworthiness Certificate says it is a C model, then it is a C model. Operate it as a C model. No Problem. Case Closed!

LEGAL ANALYSIS:
 
The local FAA office position in this sounds inconsistent if not a bit abusive.  If you had flown your bird at D model weights, you would have been violating regulations.  It is not a D model, no matter what alterations you have done, until the paper work is complete.
 
So now, even tho you could NOT legally fly it at 1400 lbs, they say they consider it a D, anyway.  They say it cannot “revert” to a C mode
 
Well, it does not need to revert.  It IS already a C model.  Period.  They cannot have it both ways.
 
The local FAA office position appears to be, to coin a legal phrase,, “horse s**t.”
 
I suggest that you keep it a C registration and explain their untenable position to them….although, perhaps, using more circumspect terminology.
 
Anybody see any holes in my logic?  I am, as always, open to opposing positions.  In all seriousness,I think this is a rather important distinction.

Here is a brief history of my coupe. The D model conversion was done in 1974. A 337 was completed and stated that the stainless steel plate over the fuel tank was installed per ERCO drawing #xyz and the gross weight adjusted to 1400lbs. The data plate was restamped in accordance with the type certificate data sheet and a revised weight and balance sheet was produced. The FAA never reissued and amended airworthiness certificate indicating that the aircraft was now a D model. Some time after that the original log books were destroyed and the airplane sat for a few years. When the next owner restored the airplane he reconstructed the log books and restored the coupe as a D model,however the airworthiness certificate still showed it as a C. I then bought the airplane and figured this all out after the fact. I have spoken with the FAA FSDO office in Boston and they feel as though it was operated as a D and if I choose to revert to a C, I would be excluded from the LSA category. The FSDO office wants me to submit a new 337 indicating that the work that should have been noted in the missing log books was completed and that the plane is in compliance with the Type Certificate Data Sheet. I thought someone might have a copy of one I could look and get an idea of what an approved one looks like.

Are you sure you want to complete the conversion, Jeff?
  Keeping the plane a C or CD allows it to be used as a Light Sport Aircraft, flown with only a driver's license for a medical.  The prices of those planes has skyrocketed lately, per the last EOC meeting.   Perhaps if I knew a bit more about what's going on.  Has an O-200 engine been installed?  Has the elevator up-travel been changed?  Do you need the 1400 pounds gross of the D and later models?

Does anyone have a copy of a 337 for the D model conversion? I am trying to clear up some paper work confusion on my coupe and would like to see the language used on other conversions.
