The way they catch you at using a cell phone from a plane (and main reason it is "illegal") is that cell phone signals are line of sight and if you are high enough your signal will be picked up by multiple towers. When they see this they know you are too high. How high depends on terrain, population/cell tower density, etc. I was once billed for the same call twice because one of the towers that picked up my call was out of my service area so I got an additional charge (nationwide plan has taken care of that....which also occurred
a couple of times when I called from my car).
I haven't seen any problem using my cell phone in central Kansas at 2,000 and below to call home or
answer a call from home.........yet.

If you're talking about using a cell phone from the plane, I'd guess 500'
would be low enough. That's what I figured I'd do if I ever needed to.
