Perhaps. You could also just charge say, Linksys, for every AP they import.

"Intermittent use" "Occasional use" "Constant use" etc.

  Plus with APs things
are moving in the direction of a Software radio which could be
reprogrammed for any portion of the spectrum and power level.  How do
you tax that?

If you are transmitting in licensed spectrum without a license, it doesn't really matter if you've paid a tax or not, since you're already violating the regs and the fine is likely to be bigger than the tax.

Depends on your definition of equitable, I suppose.
Myself, I just think it's a dumb idea, since last time I checked, the airwaves were a public resource and taxing me for using them is like taxing me for breathing the air.
