Microsoft doesn't mind lawsuits. They are always defendents in three
to five active suits. They lose some too. They've decided that the
legal fees and judgements are outweighed by the profits they make by
shipping whatever they want whenever they want.
Besides, where is Theo going to get $10M to launch a civil suit?
Apple, sure, they could sue, if they don't want to sell iTunes for
Windows anymore.
