Nikola Corporation filed the lawsuit against Tesla on Tuesday, May 1 in an Arizona-based U.S. District Court. In the lawsuit, the Utah-based startup claims Tesla knowingly copied its patents and design when creating its all-electric semi-truck. A spokesperson with the Palo, Alto-based electric car maker told The Verge [ https://www.theverge.com/2018/5/1/17309430/tesla-lawsuit-nikola-motor-company-patent-trucks ] that, "It's patently obvious there is no merit to this lawsuit." Nikola lays out a timeline and specifies how Tesla allegedly infringed upon its design on its electric semi-truck. The company says that Tesla had not announced intentions to build its all-electric semi as of May 9, 2016, and that by September 2016 Nikola had already received 300 orders for more than 7,000 trucks totaling more than $2.3 billion. Nearly three months after publishing its design, Nikola says Tesla CEO Elon Musk revealed that his company was in the early stages of developing its own all-electric semi. Another two months later, and Nikola claims that a lead Tesla recruiter reached out asking if he could set something up to study and talk with them about their electric semi-truck. "Nikola did not respond to Tesla's invitation," the lawsuit reads. In the patent infringement lawsuit, Nikola points to similarities between its own and Tesla's front fenders, windshield design and shape, some doors, aerodynamics and more as proof that the electric car maker copied its work. The company alleges it sent Tesla a letter on Nov. 7, 2017, less than 10 days before it revealed its all-electric semi, that it had "identified the semi-truck design features Nikola was patenting and demanded that Tesla not unveil its semi until Tesla's infringement had been resolved." Tesla is said to have never responded to this letter and went on with the reveal as planned. "Tesla has never claimed that its design was unique. Upon information and belief, Tesla does not have any patents protecting the design of its semi-truck and has not filed any applications for design patent protection," the lawsuit reads. "Nikola designed the wrap windshield, a unique feature in the trucking industry. The design is identifiable from a distance. The wrap windshield provides drivers an unobstructed view of the road.
