If he sends by SMTP he can specify any return address he wants. Do you allow relay by SMTP? Even if you have relay disabled, a user can send "from" that address just by adding it to the headers of the message. You should read and understand Internet RFCs 821 and 822, and their successors 2821 and 2822 and then you'll better understand how spammers ply their trade.
