Hello, thanks for all the responses. According the the clamav ml it happend to others as well and should not happen anymore if you're using 0.93 of clamav*.

We're selling this bug(?) now as feature: as exim stops transporting
mails in face of clamd failure, clamd fails scanning in face of missing
updates - always on the safe side for maximum security of our customers ;-)
