Can you divorce someone if they are not in a position to contest it?
Are you recommending  this? Teri may not want it. 

Maybe he loves her deeply, and he is BY LAW her LEGAL guardian, and 
the courts must stand by that, because that is what decades of 
wrangling over this kind of thing has been decided is the most 
humane way to procede. 
That is why the courts are deciding this way despite Bush's big 
government intervention attempt into private family lives. The 
courts are standing up for family values here and humane practices.
