My feeling is that an ISP, if it's a monopoly, should be regulated as a 
utility, like gas, water, and electricity.  Because our corrupt and untechnical 
legislators do not not understand the technology or the issues, ISP and 
carriers in general are making a legal land grab to stake out as much of this 
since they know the future is in bits not waves or atoms.  By creating as many 
legal fictions as they can and passing industry protective legislation at the 
expense of the consumer and community rights (like the ant-GMO forces), the 
citizen and the Public at large is being hung out to dry and at a very high 
cost.  

As someone said in the comments on another, but related article at arstechnica: 
 "Do you think the Post Office would be allowed to charge for both the sender 
and the recipient of mail.  That's the game ISP's are up to."
