The problem is that denying habaeus corpus to *suspected*
terrorists means that it's almost impossible for those
among the suspects who may not actualy be terrorists to
prove their innocence.

Judy quite frankly I didn't know if he meant prosecuted or persecuted so I took him for his word. I am unaware of any attempt to suspend Habeas Corpus. However I think it is already something a judge can do if they think the suspected person is a "flight" risk.
