It's done that way here but only on contigency cases which are
almost always liability cases, not constitutional issue ones like
this.

It really sounds more child like than anything else. Kind of like the person that takes their beloved dog to the vet to save it's life and the vet does everything in his power but the animal expires and the owner doesn't think he owes the vet anything because he didn't save its life.
