It's a matter of record that many of those
incarcerated at Guantanamo have had to be
released (after years in detention) because
there was no evidence they were involved in
any terrorist operations.  Many who remain
have still not been charged.

It's also a matter of record that a number
of detainees were captured by warlords in
Afghanistan and turned over to the U.S. in
exchange for a bounty without ever having had
any connnection to terrorism or anti-U.S.
actions.

And then there's Jose Padilla, and all the
suspects that have been subject to "extraordinary
rendition," and the secret prisons the CIA was
running in other countries (and almost certainly
still is, despite U.S. denials).

And that's just the tip of the iceberg.
