Hey, I'm not the best informed person on here but I don't like to see a question go unanswered, so this is subject to anything that anyone else may wish to say on the topic.
Perjury came up in Q7, October 2007 and the examiner's report on it is quite detailed. It says it's a common law offence and gives the following caselaw: AG v Oles, 2002 and Looney v Bank of Ireland SC Unrep. 1997. Apparently also, one could refer to the Law Reform Commission Report on Oaths and Affirmations, 1990 (but it's not like I'd have a few copies of it in the back of the wardrobe...). I would have very little to write on perjury, just the definition and the mens rea really. Unfortunately, the April 06 reports are really short for criminal. In my notes on scandalising the court, I have the following caselaw:The State (DPP) v Walsh, 1981 and AG v Connolly, 1947. For contempt in facie curia I have: Morris v the Crown Court, 1970 – welsh student protests; Assaulting a witness, juror or judge – Mitchell v Smyth, 1894; Insulting behaviour – Ex parte Tanner, 1889; Attempting to persuade a witness not to attend court – Kelly v Deighan, 1984; Refusing to be sworn in or answer a question as a witness and refusal to reveal journalistic sources on the grounds of privilege. In re O’Kelly, 1997. On Sep 27, 6:22 pm, tiger <[EMAIL PROTECTED]> wrote: > Hey > > Has anyone got any relevant case laws for perjury or contempt (in > particular scandalising the court).
