The reports arrived today anyway. I wouldn't bother ordering them if
you're just sitting tort. The tort examiner has provided four or five
lines of info per question and then with the general comments thrown
in, this expands to a bumper one-and-a-half pages. The criminal report
on the other hand comprises 16 pages. Like everything else to do with
the FE-1s, there is no rhyme or reason in the reports...

Anyway, the tort report can be summarised as follows:
People continue to write general answers to questions which were
intended to focus on particular aspects of topics. The examiner also
complains about the unwillingness of candidates to "deal with relevant
statutory provisions", so I'd say you'd really get the examiner on
side and get extra marks if you paid attention to that aspect in
answers where possible. The comments on the individual questions are
very short and general:

1. Statutory provisions surrounding consent and waiver. Answers did
not show critical understanding.

2. Nervous shock. Problems included lack of discernment, generic
answers.

3. Limitation of actions. Candidates had patchy knowledge.

4. Occupiers' Liability. Candidates ignored statutory provisions.

5. Economic Loss. Confusion and lack of basic knowledge.

6. Defamation. Answers were too general despite the Q highlighting
specific areas.

7. Intentional Torts / Trespass. Straightforward area, Q not popular.

8. Vicarious Liability. Candidates could identify the topic but showed
confusion.
