Anyway, to the point: Freedom of establishment—Restriction on operating pharmacy—Whether justified by objective of protecting public health—EC Treaty, art.152 (5) On December 16, 2008, Advocate General Bot delivered his opinion in Case C-531/06 Commission v Italy and Joined Cases C-171/07 and C-172/07 Commission v Italy/Apothekerkammer des Saarlandes and Others .
