The examiner has proved time and time again that it's important to
keep up to date with case law...

Anyway, to the point:

On December 16, 2008, Advocate General Bot delivered his opinion in
Case C-531/06 Commission v Italy and Joined Cases C-171/07 and
C-172/07 Commission v Italy/Apothekerkammer des Saarlandes and
Others . He concluded that the ownership and operation of a pharmacy
could be reserved exclusively to pharmacists, and that German and
Italian laws laying down such rules were justified by the objective of
seeking to guarantee an appropriate supply of medicinal products to
the public.
