Good point, though i think it would be more relevant to an
administrative law perspective...no doubt you could have quoted
o'keefe v an bord pleanala and made reference to the anxious scrutiny
test...

The question asked was very similar to ones asked before and it was
understood that equality was most relevant to the question...no doubt
the above would be relavent and get you extra marks...

But then again, i haven't a clue what the examiner wants!
