That's one issue. Another is whether it is reasonable to receive a patent for the various clicking patterns in the first place. In my view, it's absurd to give patents for such things -- same with Amazon's "one-click buying." These are just not patentable ideas.

I quite agree with you, but that assumes reasonable human beings making the decisions, and ever since the first look-and-feel patent case (wasn't that lotus, or was it excel?) it has been eminently clear that reasonableness and patent-office-employment are mutually exclusive concepts.
