Thus proving your initial assertion to be incorrect: the UK is the part of Europe to which this law is new with the Hyperion decision. It may be that the judge decided to do a unilateral unification of the UK legal system with that of the rest of the EC, but if so he was out of order, because the normal process for that is an Act of Parliament.
