Well, maybe, but it looks to me like a grammatical brain-fart, not a legal one. Sort of like when people say "between 15 and 20" when they really mean "15 through 20". As an editor, I've seen that sort of thing a lot: authors who obviously know their material well but then say something stupid anyway because they get the words wrong.
