Not without paying them the license fee, or having the current
registered user of that version contact MakeMusic and officially
relinquish all rights to that serial number and turn it over to you.
Used copies are not licensable copies unless/until the registered user
of that serial number has surrendered it.
And even though David has a current serial number, he hasn't paid the
upgrade fee, so he will likely need to pay MakeMusic whatever the cost
was to upgrade from his previous version.
But only MakeMusic can give you the definitive answer, so call them up.
