I refrained from suggesting that when I noticed the ties -- we don't 
know what comes next and it might be problematic to have the top note 
of the chord in the top staff. If it's not, though, it's 
unquestionably the best choice.

But I assumed that since that hadn't been chosen, there must have 
been as good reason in what followed.
