The only way this would be possible, i think is if fink used its own user to build things, a "fink" user. Then you would get a permissions error if something were installed outside %d.

When making packages, it is usually best for maintainers to build first *manually* replicating what fink does, substituting /tmp for %d. Then you will get permissions errors if something tries to go into /sw directly.
