Fink really only uses a separate crypto tree because it was based on debian, which also used to do so. debian recently dropped the seperation requirement. They have scripts set up to send the proper crypto notifications to the US authorities and various other things, see

Pur agreement was that we need to keep crypto for now. We are not sure in how far we are willing to commit to reporting to the US, etc., like debian did. Options we were considering including moving to a non-US location for our bindist / source archive.
If (and that's an "if" with a question mark) we abolish crypto, then not in a rush. It's easier to abolish something than to undo that change later. Also, don't forget it's not necessarily just a choice between "crypto" or not. Another possibility is that just "openssl" and the various "-ssl" packages go, while retaining a crypto tree with gpg etc. I don't say that's better, I just try to remember that this is not a binary choice :-)
