The case as you state it seems clear to me. I'm removing the package. (As you have undoubtedly discovered yourself, the maintainer's email does not function.)
While it is correct to remove the package (DMCA and PATRIOT acts being what they are), I think that the meaning of all this is that the restriction stated in the fatback manual is a violation of GPL.
