The /sw/bin/install from Fink's fileutils pkg has different commandline options than the /usr/bin/install that comes with OS X. And as you notice, "install" finds Fink's if it is present. So if you really want OS X's regardless of whether Fink's is exists, just call it by its full path: /usr/bin/install instead of just "install".
