The person who killed Mr. Ileto is Buford O. Furrow, Jr.  You should all
know that:
1) Furrow was a convicted felon disqualified from owning guns by condition
of sentence (see Appendix F. of his Judgment on the conviction and the
Statement of Defendant, item 6,(s)) in Furrow's prior criminal record

2) Furrow's prior conviction was for 2nd degree assault at the Fairfax
Psychiatric Hospital in Kirkland, a Seattle suburb, where he had sought
treatment
3) The sentencing judge specifically reminded Furrow that he was prohibited
from owning Firearms as a result of his plea and Furrow signed a document
acknowledging that fact as well as agreeing to a search of his home for
firearms
4) Furrow had been an FFL and police knew he had owned firearms in the past,
but did not search his property to secure firearms.  One corrections
official told CBS News, 'We planned to [search]; we just hadn't gotten
around to it yet.'
5) Furrow killed a postal worker using a Glock semiautomatic pistol which
was originally purchased by the police department in Cosmopolis, Grays
Harbor County and later sold to Furrow.
6) Furrow's gun purchases were made in Washington State almost 1000 miles
distant from the location of the daycare center where he wounded 5 people
and later killed the postal worker.

The key point in this was that a police department sold the gun at issue to
Furrow in a legal transaction.  At the time Furrow was an FFL.  When Furrow
became disqualified to own firearms, the police neglected to search Furrow's
property to secure firearms they knew he owned.

To me, the government intermediaries in the gun transaction and in
neglecting their duty to retrieve firearms from a convicted felon will
provide a good defense to Glock on this case.  It appears to me that by
bringing this case some are prepared to make the law a joke.

The 9th Circuit Court of Appeals declined to have a larger en banc
panel of judges reconsider its 2 to 1 November ruling that allowed a
lawsuit against Glock Inc. and gun sellers. The suit alleges negligence
for using a distribution scheme that made it likely their guns would end
up in the hands of illegal buyers.

The case stems from the murder of a postal worker, Joseph Ileto, who
was shot by a white supremacist.   *  *  *  Relatives of victims filed a
lawsuit charging gun makers used negligent marketing strategies that
caused their guns to end up in the hands of the wrong people.

A majority of the 9th circuit voted against rehearing the case,
although eight judges dissented. The court normally has 26 judges but it
does not announce the number who form a majority in a given opinion.

"The potential impact of the panel's decision is staggering," Consuelo
Callahan wrote for the dissenting judges. "Any manufacturer of an
arguably dangerous product that finds its way into California can be
hauled into court in California to defend against a civil action brought
by a victim of the criminal use of that product."

"Thus General Motors would be sued by someone who was hit by a Corvette
that had been stolen by a juvenile," she wrote.


"The plaintiff would allege that General Motors knew that cars that can
greatly exceed the legal speed limit are dangerous, and through
advertising and by offering discounts, increased the attractiveness of
the car and the number of Corvettes on the road and this increased the
likelihood that a juvenile would steal a Corvette and operate it in an
injurious manner."
