I am having a little trouble finding the decision in the Utah courts for University of Utah v. Shurtleff. I have found an appeal at http://attorneygeneral.utah.gov/HPI/Brief%20of%20Defendant_Appellant%20U%20of%20U%20v%20Shurtleff_.pdf that suggests that Shurtleff was appealing this beyond the Utah 3rd District decision, but I don't have access to Lexis, so I don't know if there was a Utah appellate court decision, so I don't what (or where) the final decision is.
