Subject: Correction of abuse of discretion by predecessor

Dear Mr.Paulson:

Your predecessor, Lloyd Bentsen, Jr., committed an abuse of discretion
as Secretary of the Treasury in 1994 that is long overdue for
correction. He issued an administrative finding that several 12-gauge
shotguns, the USAS-12, the Striker-12, and the Street Sweeper, are
"destructive devices" subject to mandatory registration. Congress never
intended that any 12-gauge shotgun be so classified.

The apparent motive for this was that these weapons had characteristics
that put them under the Law enforcement Act of 1994, removable magazines
and a pistol grip. However, that Act expired September 13, 2004 and has
not been renewed.

For many years the BATFE took no steps to enforce the finding. Then,
about 1989, began circulating notices that it would begin to accept
registrations, and setting a deadline to register. However, the notices
were inadequate, and the forms they offered for registration had several
defects, failing to allow for ownership by a corporation, and even
requiring the registrant to sign, under penalty of perjury, that he was
the manufacturer, when he might only be a purchaser. Such a ruse must be
rejected as constitutionally infirm.

I urge you to rescind the finding. Besides demonstrating a willingness
to take seriously your oath to defend the Constitution at a time when
such willingness in this Administration is suspect, it would avoid
prosecutions that would be manifestly unjust.
