Do you have "Off for all pages" checked (it shouldn't be checked)? Do you click on the "Off" button instead of the minimize (use the minimize button)? Try resetting all Firebug options by going to the firebug menu (top left in the overlay) -> Options -> Reset All Firebug Options.
I'm not a firebug developer, but 1.4 works extremely well.
