This is typical sloppy, overhyped, exaggerated, uninformed popular-press rubbish. The 
ruling simply held that it is not a crime to conduct a port scan. It didn't say that 
exploiting vulnerabilities is ok. In my opinion, there's a world of difference between 
scanning for open ports, and trying to exploit a vulnerable service. The ruling did 
NOT indicate that attacking a machine is permissible as long as you don't succeed, as 
this article seems to suggest. 

Secondly, this is not a new story. HNN (www.hackernews.com) reported this story 
several weeks ago. Please understand, I'm not flaming the original poster, I just wish 
the popular press would make more of an effort to get the facts right, and spend less 
time exploiting the popular fear of "hackers."
