what worked for me was this:
 
     _tree.addEventListener(FlexEvent.UPDATE_COMPLETE, _treeDataChanged);
     _tree.dataProvider = _data_xml;
 
  private function _treeDataChanged(e:FlexEvent):void
  {
     //remove the listener so the user can open and close items
     _tree.removeEventListener(FlexEvent.UPDATE_COMPLETE, _treeDataChanged);
     _tree.expandChildrenOf(_tree.firstVisibleItem, true);
  };
