*Questions & Answers*
1. *Question:* Here in Australia by the *tawfeeq* of Allaah a couple
reverted to Islaam, *walhamdulillaah* (and all Praise is due to Allaah). The
brother who gave da`wah to the sister became the guardian (*wali*) of the
sister and helped get her married. Is this marriage valid? The marriage took
place in the presence of two witnesses, and the head of the local Islaamic
Center executed the marriage. However, based on the fact that the brother
who was the *wali* is not the Imaam of the masjid or the head of the Center,
is that okay?
*Answer:* The Shaykh رحمه الله asked for clarification as to who helped
arrange the marriage. The moderator explained that the brother who gave
da`wah to the sister who reverted became the *wali* because the sister did
not have any relatives. The moderator further clarified that the brother is
not an imaam of the masjid and is a Da`ee. The Shaykh then affirmed that he
understood the question and proceeded to answer:
Inshaa Allaah it is easy. They can now go and redo the contract with a *wali
* that she assigns. Do you understand?
The moderator said: I think that the question stated that she selected him
to be the *wali*.
The Shaykh explained: As he is not the head of an Islaamic Center or in a
position of authority, to be on the safe side they should redo the contract
after she assigns the head of an Islamic Center to redo the contract.
2. *Question:* I have house-birds in my home. Their droppings get on the
carpet. I do not pray in that room. However, are the droppings of birds
considered impure?
*Answer:* Inshaa Allaah their droppings are pure.
3. *Question:* Is it permissible to have wall hangings in the house with
verses written from the Qur’aan or similar to that?
*Answer:* This had been something of concern to our Shaykh رحمه الله (
Shaykh Uthaymeen) for a very long time and he disliked when these verses are
hung on walls. Firs of all, they are not meant to be hung, the verses of
Allaah are not meant to be hung. This is especially asserted in situations
where you find people sitting in gatherings/circles and participating into *
gheebah* (backbiting), speaking ill of others etc. yet these ‘reminders’ are
over their heads. In a way, this is belittling the *aayaat* (verses) of
Allaah سبحانه وتعالى when they are placed in this manner. Our Shaykh
(Uthaymeen) رحمه الله had a *fatwa* (religious verdict) on this stating that
*this should not be the practice of Muslims*; the aayaat should be respected
and not put on the walls.
In this is a reminder regarding another issue, where in many homes you find
the name ‘Allaah’ in a frame and on the same level you find the name
‘Muhammad’ صلى الله عليه وسلم. This is another thing which our Shaykh رحمه
الله spoke against. He said this is a matter in which one makes them both
equivalent in magnitude and therefore this should *not be done*.
Additionally, another benefit we may derive is that in many Muslim homes you
find the name ‘Muhammad’ framed with the following wording: ‘Yaa Muhammad’
(O Muhammad). This is done seeking Muhammad’s صلى الله عليه وسلم help or
refuge etc. This is a form of *shirk* even though it is found in many
places. It remains a very serious matter which people should be aware of
because *all* worship, du`aa etc. should be done sincerely for Allaah سبحانه
وتعالى (alone).
4. *Question:* A family member owns an internet café. Many people come to
access (the internet) for different reasons (perhaps work, email etc.), but
there are some who visit porn sites. My family does not permit such sites
and there is a sign above each computer stating that it is not allowed to
surf such sites. However, there are still some who will go to such sites. If
they are seen they will be told not go to such sites but they
(owner/employees) cannot keep on eye on every computer, so there may be
someone who may go to such sites unnoticed. Is the money earned from this
business *halaal* (lawful)?
*Answer:* With respect to this matter, if there is no way of controlling the
access to the internet in an internet café then in this case we say *leave
that which is doubtful for that which is not doubtful*[15]. This is unless
there is a means by which some security may be implemented whereby such
access is prevented. If this effort is made and thereafter some sort of leak
(security breach) occurs – once or twice, due to the inability to watch over
them and they are able to gain access, then inshaa Allaah in this case they
fall under the statement *{Fear Allaah to the best of your ability}*[16] and
Allaah سبحانه وتعالى, the Most High knows best.
5. *Question:* This question is from a prisoner. He says that he is in
prison and there are some Muslims and non-Muslims inmates who open up stores
where they give things for delayed payments. For example, today one may
agree to receive deodorant, soap or an item of food and then pay double the
price the following day. Is this transaction *halaal* (lawful) or is it
considered *ribaa*?
*Answer:* The Shaykh clarified: He sells these items in jail?
The moderator answered: Yes they sell these items in jail due to limited
resources. An inmate may give another inmate an item with the condition that
they be given double the value in return.
The Shaykh asked: Is it like an instalment where they don’t pay anything?
The moderator replied: No, it is not mentioned in the question.
The Shaykh then answered: With respect to this, in accordance with opinion
that delayed payment is permissible, then inshaa Allaah there is no harm.
6. *Question:* I wanted to ask if it is permissible in Islaam for ladies to
take the ‘morning after’ pill as a course of emergency? This is if they
engage in sexual intercourse with their husband, without protection or if
the contraceptive which they are using gets damaged.
*Answer:* The Shaykh requested clarification:
Shaykh: What is it that they are using?
Moderator: The ‘morning after’ pill.
Shaykh: You mean contraceptives?
Moderator: Yes, they take the pill a day after in the morning, the ‘morning
after’ pill.
Shaykh: Is this normally the procedure used for taking this type of
medication (contraceptive) for example?
Moderator: It may not be legal in all states – it varies from country to
country (and state to state) but sometimes they (the people) do that.
The Shaykh then answered by saying: The general ruling with respect to this
has been laid down by many of the respected Scholars of Islaam in our times.
They said that if there is no harm in taking the contraceptive pill then
this is permissible in situations where it may be needed for organization
(spacing out the children). It must not be used as a means of total
prevention (to avoid having any children at all).
7. *Question:* I heard that some of the Sahaabah (Companions) wore earrings
during the lifetime of the Messenger of Allaah صلى الله عليه وسلم. Is this
narration authentic or not, and is it permissible for men to wear earrings?
*Answer:* I do not know of the authenticity of this report. However, with
respect to our times it is practiced by people who affiliate or associate
themselves with people known as gays or lesbians (homosexuals) and
therefore, from this angle, imitation of them is *forbidden*.
8. *Question:* Does a sister have to meet potential brothers for marriage
because her mother wants her to do so? Should she meet the brothers out of
respect for her mother's wishes and then say no to the brothers because they
don't meet her own standards?
*Answer:* The Shaykh clarified:
Shaykh: She wants to meet them?
Moderator: Yes, the mother would arrange for the brother to come and the
sister would sit and see the brother.
Shaykh: The mother? Is there no *wali* (guardian) from her *mahrams*?
Moderator: It is not mentioned in the question.
The Shaykh then answered by saying: In this case there must be a
*mahram*from her legal
*mahrams* at the sitting when a potential person comes seeking her hand.
Having no *mahram* and sitting alone with him is forbidden. If she doesn’t
have a *mahram* i.e. a guardian, then in this case she may assign a *
non-mahram* who can meet this brother. They may then arrange a certain
sitting such that the individual and potential fiancé are not alone but
rather a setting where there may be three people. He can see her and she can
see him, ask the questions and then finalize later on.
9. *Question:* This question is from a sister who says her husband has a
problem with watching pornographic movies on television. She has had this
problem for a long time and has tried to be patient with her husband but to
no avail. She does her best to beautify herself for her husband and to do
everything possible he would want, but her husband is still into pornography
and other things (I seek refuge with Allaah). She asks if this gives her the
right to get a *khula* (annulment)?
*Answer:* With these types of question and especially in terms of seeking *
khula* and divorce, we advise that people email their questions to:
[email protected] because these are very sensitive matters and there
could be a lot of potential advice and help given to these people. It is
also a precaution lest others deduce a generalization from a certain advice
and/or answer. They may send it to that email address and inshaa Allaah it
will be answered.
10. *Question:* The next question is from a brother who asks if we call
Allaah سبحانه وتعالى a thing?
*Answer:* The Shaykh رحمه الله clarified: You mean *‘shay’* (شيء – a thing)?
The moderator affirmed this.
The Shaykh then answered by saying: The name ‘thing’ came in the Qur’aan in
Surah al-An`aam, chapter 6 verse 19. Allaah سبحانه وتعالى says:
قُلْ أَيُّ شَيْءٍ أَكْبَرُ شَهَادةً قُلِ اللّهِ شَهِيدٌ بِيْنِي وَبَيْنَكُمْ
*{Say (O Muhammad صلى الله عليه وسلم): "What thing is the most great as
witness?" Say: "Allaah (the Most Great!) is Witness between me and
you…}*[al-An`aam 6:19]
So the name ‘thing’ was mentioned in this verse. In his Saheeh, Imaam
Bukhaaree in the Book of Tawheed, dedicated a chapter and named it as: ‘*
Baabun*’ (باب – Chapter) followed by the same part of the verse mentioned
above (6:19) and then ‘So Allaah named Himself *Shay’* and the Prophet صلى
الله عليه وسلم named the Qur’aan *Shay’* and it is an attribute from the
Attributes of Allaah’.[17] However, it is not to be said: ‘*Ash-shay*’ –
‘the thing’; this is different.
The Shaykhرحمه الله then gave salaams to everyone and ended.
