I have exactly the same issue. According to the PSPad Tidy config file the default encoding should be ascii, so I have no idea why it's converting ® and © to actually characters from the high end of Latin-1. When I use the command line version of Tidy I also do not get this problem. It's a shame as I've got to drop out of PSPad to run Tidy which is a pain.
