Eh, why mod fail? He apparently subscribed to the list and posted afterwards, there is nothing we can do to prevent this or would you like us to check all new subscription requests (how?) ?
For the record, all emails by non-members at the moment get automatically rejected with an email saying that they can email foundation-l-owner if they absolutely want to post without being subscribed. The poster has now been unsubscribed.
