Commons requires that all images be free of copyright in both the US and their country of origin. Since most of the non-treaty countries do have domestic copyright laws, the restrictions originating from such laws continue to be enforced on Commons. The notable exception is Afghanistan which apparently has no domestic copyright laws at all.
