Subject: Selectmen's Update July 27, 2001 40B Application Late this afternoon Edmands Realty Trust filed a 40B application for 60 units of over 55 housing on Edmands Road just west of the Edmands House. These developers were working with the Planning Board to gain approval of the bylaw that was withdrawn from the June Town Meeting. They had threatened to use 40B, if the bylaw did not pass, and that has come to fruition. The Planning Department will review the application next week and I will provide further details. There is still the outstanding legal issue of the possible certification in excess of 10% and how that will impact the application. Will the date of application or the date of approval be the determining factor? Kathy Bartolini believes that the Commonwealth could act upon our new certification number in the very near future. Tree Cutting in Wetlands Obviously I do not endorse Town departments not following our bylaws, be they zoning, conservation or any others. I made that point clear at my developmental staff meeting this morning. The Conservation Commission has written a letter to many Town departments and boards on this issue that was distributed this morning. I will be responding for all Town departments assuring them that it is our intent to follow the laws, as it has been in the past and will be in the future. I did inquire as to how the cutting was done on Edmands Road. At one point I had believed that Public Works crews did the cutting, but that is not the case. A private cutter working for the engineering firm did the cutting. John Bertorelli knew they were working along the easement, but he said the wetlands were delineated, and the engineering firm should have recognized the need to avoid cutting there. It is unfortunate that this did not happen in this instance. Although, not an excuse, he did point out that the wetlands involved are identified only by vegetation, they are not noticeably wet or swampy, so perhaps that had an impact on the decision of the private firm to keep cutting. I have firmly stressed the need to be sure we follow all our laws in all cases and that this does not happen again.
