Hello Steve: Thanks for everything involved with making last night a "first step". I agree with most everything you say, but if the developer keeps on doing what he is doing, we have achieved nothing.
In my opinion, based on some professional education in Mechanical Engineering and Fluid Dynamics, what the developer has build has the effect of channeling the runoff from at least 1 1/2 to 2 arces OFF THE PROPERTY as rapidly as possible. Only 5000 gallons of a potential 100,000 gallons or more are retained on Doe II. This is conservative estimate, even considering 50% of the water sinks into the soil (unlikely). If we get a few drenching thunderstorms, or, God forbid, a hurricane, the silt fences and hay bales will not be able to resist the high speed flow and high weight of the water and silted water running off of Doe II. As a gallon of clear water weighs about 8 pounds, 100,000 gallons = 400 tons. Even over a 5 hour period, this is the force of 40 to 80 tons per hour coursing through that 5' wide opening at the lower corner of Lot 7A. That will surely push over anything in it way in the form of a PE fence or hay bale.
