Thank you again to all who volunteered to assist on this issue. Here is an update on what I found: Changing the <PgfLocked Yes> to <PgfLocked No> allowed me to then change the tag applied to the paragraph to something that would not end up affecting the header.
My previous solution of deleting all the XML in the MIF file worked, but it was indeed overkill. I had forgotten that you cannot delete the last paragraph in an FM document anyway. The other odd behavior I see is that being the last paragraph it is not showing the section sign text symbol like I have seen in every other Framemaker file.
