I'm not sure if this matters, but I had my AI tool review the patch and it made
an interesting observation.

It does make me wonder if this difference might have any downstream side
effects where other code expects one behavior or another.  In particular I
wonder if there are programs that always expect the return to be an empty list,
since that's likely the more common case.
