Was that the FreeBSD fdisk or the Microsloth one?
I have never seen that happen with the FreeBSD version.

Probably.  If you can get booted to something FreeBSD you can
run fdisk on it and choose the active slice.

By the way, if slice 1 has only data, then when you run disklabel on
it don't tell it to put in the boot records (boot1 and boot2 - fdisk 
puts boot0 in the disks main boot sector).
