Please forward this to anyone who can help. The perfect candidate would
be a radio amateur who is a patent attorney.

Currently there are two independent Open Source implementations of the
AMBE codec used in D-STAR. The remaining issue before radio amateurs can
use them safely is the patents in force upon that technology.

Through the pro-bono work of a intellectual property professional, we
have arrived at the belief that the date of public disclosures made by
DVSI would make their U.S. patents on the AMBE 1000 chip unenforcible
after a date later this year. We believe that the AMBE 1000 chip is
capable of the mode of operation used for D-STAR, and that thus it would
be legal to implement all-software D-STAR systems upon that date,
without use of technology incorporating DVSI products such as DV-Dongle.
Modes first implemented in AMBE 2000 and later devices are covered by
patents of longer, though finite, scope.

We need an attorney to confirm these conclusions - or otherwise, and the
attorney available to us doesn't focus his practice on patents. The
perfect candidate would be a radio amateur who is a practicing or
retired patent attorney, does not have conflicts concerning Digital
Voice Systems Incorporated, and who is willing and able to donate their
services for the good of Amateur Radio. Findings would be made to a
non-profit and shared with any party who wishes to produce software AMBE
implementations.
