I am under the same impression.  But here's a quote from the MySQL site:

So, the fine line is...if you are a consultant to creates kiosks for
clients, then they have to pay.  If you are an employee of a company that
uses MySQL in a product, you don't have to pay.  Kind of weird.  I suggest
asking someone at tcx how they interpret your situation, Johann.
