I decided to fact-check my claim that we're litigious. Luckily, I found an article

that disagrees with me. They argue that our "first order law" is on par with other wealthy
democracies (and do discuss some other systems as well). But the conclusions of the article also relate
to the idea that Trump knows how to play our judicial system. They claim the "second order
law", e.g. class actions, is where we are distinguishable. A fun passage is:
'As the pre-eminent class-action lawyer William Lerach once infamously
bragged (now, for his litigation tactics, a convicted felon): "I have the
best practice in the
world. I have no clients."'
I'm too ignorant to make an argument that election-related court cases and such are
"second order". But the recent shenanigans with judges Cannon and Kacsmaryk
feel like that to me.
